Shareholder Janetta Ksar and Associate Christopher Chesney of Zausmer, P.C. recently presented at the Michigan State Chapter of the International Association of Special Investigation Units (IASIU) Conference, held on October 17, 2019 in Livonia, Michigan.
Their presentation, entitled “Facebook, Fitbit & Fake News: Fighting Fraud in the Digital Age,” focused on collecting and authenticating electronic data from social media website and online applications including Facebook, Instagram and Snapchat, and personal fitness activity trackers such as Apple watches and FitBits. They also discussed the application of the Michigan Court Rules and Rules of Evidence and precedential case law supporting the use of electronic data in identifying and defending fraudulent insurance claims.
In addition to guiding the audience through the legal requirements for electronic discovery and data, Janetta and Chris provided the adjusters, attorneys, law enforcement officers and other members of IASIU in attendance with real-world examples of investigating and compiling data, and the introduction of electronic discovery as a basis for successful legal defenses in court to combat fraudulent insurance claims.
